MileStreak — Terms of Service

These terms are the agreement between you and Kevin Rudd about using MileStreak. By creating an account, you agree to them. If you do not agree, do not create an account — and if you have one, delete it in Settings.
What MileStreak is
MileStreak counts how many days in a row you have run, and shows you that number.
It works out that number from your runs. With your permission it reads those runs from Apple Health on iPhone or Health Connect on Android, and you can also type runs in by hand. You set the rule for what counts as a running day — a minimum number of miles or minutes — and a day counts if at least one run that day meets it.
MileStreak is a counter, not a coach and not a doctor. It is not medical advice, it is not a fitness plan, and it does not know anything about your health beyond how far and how long you ran. Decisions about whether to run, how far, or whether to run at all when you are hurt or unwell are between you and a qualified person. Nothing in MileStreak should be used as a reason to run through an injury.
MileStreak is free to use. One optional subscription removes the MileStreak band from your share picture. Everything else is free and is intended to stay free.
Your account
You need an account, because your streak lives on MileStreak's servers so that it survives a lost or replaced phone.
- You must be at least 13 years old to create one.
- Give a real email address. If you mistype it, you will not be able to reset your password, and there is no way to recover the account.
- Your password is yours to keep safe. Anything done through your account is treated as done by you.
- One account per person.
- If you think someone else is using your account, write to kevin@nextmindadvisors.com.
What you may do with MileStreak
Use it for your own running, on your own devices, as much as you like. That is what it is for.
What you may not do
- Do not try to break into other people's accounts or data, or poke at MileStreak's servers looking for a way in.
- Do not take MileStreak apart, copy it, or build a competing product out of it.
- Do not use automated tools to hammer the service, scrape it, or sign up in bulk.
- Do not upload or submit anything unlawful, or anything that is not yours to submit.
- Do not use MileStreak to break the law, or in a way that breaks Apple's or Google's rules for their stores.
- Do not resell MileStreak or charge other people for access to it.
Faking your streak is not on this list, and that is deliberate. You can type in any number you like. If you lie to MileStreak you have only lied to yourself, and the number stops being worth having. That is the whole point of the app.
If you do something on this list, your account can be suspended or deleted. Where it is reasonable to do so, you will be warned first.
Runs, streaks and accuracy
MileStreak tries hard to get your number right, and it is built so that it never shortens a streak just because it could not see an old run. But it depends on things outside its control:
- whether your watch or running app actually sends your runs to Apple Health or Health Connect, and how quickly
- how much history your phone is willing to share
- whether you gave permission, and whether you logged a run by hand
- your phone having a working internet connection when you open the app
So: MileStreak does not guarantee that your number is correct. It cannot. A streak shown in MileStreak is a record of what MileStreak was able to see and what you told it, and nothing more. It is not proof of anything, it has no value outside the app, and it is not worth money.
If your number is wrong, tell me at kevin@nextmindadvisors.com. That is a bug and it will be treated as one.
Paying for the subscription
- Two plans: Monthly, $1.99 a month, or Yearly, $10 a year, in US dollars. Outside the US, Apple or Google show you the price in your own currency before you buy. There is no free trial.
- Payment goes through Apple or Google — the App Store on iPhone, Google Play on Android. You are charged to your Apple ID or Google account when you confirm the purchase. Kevin Rudd never sees your card details.
- It renews automatically at the end of each month or year, at the same length and price, until you cancel. Cancel at least 24 hours before the end of the current period to avoid the next charge.
- Cancel it in your phone's own subscription settings, not in MileStreak: on iPhone, Settings → your name → Subscriptions; on Android, Google Play → your profile → Payments & subscriptions → Subscriptions. It keeps working until the end of the period you paid for. Deleting your MileStreak account does not cancel your subscription.
- Refunds are handled by Apple and Google under their own policies, not here.
- Restore purchases on the subscription screen brings a subscription back on a new phone.
- The price can change. If it does, you will be told before it takes effect and you can cancel.
- If payment fails or you cancel, the band comes back when the period ends, and everything else keeps working.
Changing or stopping MileStreak
Kevin Rudd may change MileStreak, add features, remove features, or stop running it altogether.
For a change that materially affects how you use the app, you will be told inside the app. If MileStreak is ever going to be shut down, you will be given at least 30 days' notice and a way to get your streak data out before it goes. If you are paying at the time, you will not be charged beyond the shutdown.
Kevin Rudd may also change these terms. The date at the top shows when they last changed. If a change matters, you will be told in the app. Carrying on using MileStreak after that means you accept the new version; if you do not, delete your account.
Ending it
You can delete your account at any time in Settings → Delete account, or by email, as explained at https://milestreak.com/delete-account. In the app it deletes everything immediately; by email, within 7 days. Either way it cannot be undone. Cancel any subscription separately, in your phone's settings.
Kevin Rudd can suspend or end your access if you break these terms, or if MileStreak stops operating. If that happens for any reason other than you breaking these terms, you get the notice described above.
No warranty
MileStreak is provided "as is" and "as available", with no warranties of any kind, express or implied — including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
In plain English: it is one person's app. It is not promised to be free of bugs, to be available all the time, to work on every phone, to keep working when Apple or Google change something, or to produce a number that is correct. It is given to you in good faith and in the state it is in.
Some states do not allow some of these exclusions, so parts of this section may not apply to you.
Limitation of liability
To the fullest extent the law allows, Kevin Rudd is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, lost streak, lost profits, or loss of goodwill, arising out of your use of MileStreak — even if the possibility of it was known.
To the fullest extent the law allows, total liability for any and all claims relating to MileStreak is limited to the greater of (a) the amount you actually paid for MileStreak in the 12 months before the claim, or (b) US $20. For nearly everyone, the amount paid is nothing, because MileStreak is free to use.
Nothing here limits liability for anything that cannot legally be limited — including fraud, or death or personal injury caused by negligence. Some states do not allow some of these limits, so parts of this section may not apply to you.
Your data
What MileStreak collects, why, where it goes and how to delete it is in the privacy policy. It is part of this agreement, and it is written to be read, not skimmed. The short version: your runs are health data, they are never sold, never used for advertising, and never shared with anyone else for their own purposes.
The legal bits at the end
- Governing law. These terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict-of-laws rules. Any dispute goes to the courts of Pennsylvania. If your own state's consumer protection law gives you rights you cannot sign away, you keep them.
- Apple and Google. MileStreak is distributed through their stores. Apple and Google are not parties to this agreement and are not responsible for MileStreak, but Apple is a third-party beneficiary of these terms and may enforce them against you. Their store terms apply to you as well as these. On iPhone and iPad, Apple's standard Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) also applies to your use of MileStreak.
- If part of this fails. If any part of these terms is found unenforceable, the rest still stands.
- No waiver. Not enforcing part of these terms once does not mean giving it up.
- The whole agreement. These terms and the privacy policy are the entire agreement between you and Kevin Rudd about MileStreak.
- Transfer. You cannot transfer your rights under these terms. Kevin Rudd may transfer them if MileStreak is sold or reorganised, and you will be told if that happens.
